Facts

Prescott Sanchez, Inc. dba Home Instead Senior Care is owned by Carter Jordan Prescott and Gregorio Valentine Sanchez, Jr., and it is a franchisee of Home Instead Senior Care. It is engaged in the business of providing care for elderly and disabled clients in their homes. Oreyda Paramo-Domio was employed by Prescott Sanchez. On September 10, 2020, Paramo-Domio filed suit against Prescott Sanchez and its owners, and she filed a first amended complaint on January 6, 2021.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that the defendants failed to pay wages timely; failed to pay wages due upon separation timely; failed to pay minimum wage; failed to pay overtime wages; failed to provide accurate, itemized wage statements; failed to reimburse necessary business expenses; failed to maintain proper records; engaged in unfair competitive practices; and that the defendants were liable for penalties under the Private Attorneys General Act.

DEFENDANTS' CONTENTIONS: Defendants denied any wrongdoing or liability and all the plaintiff's material allegations.

Settlement Discussions

The parties participated in a mediation session with the Honorable Steven Denton, during which they agreed to the basic terms for a proposed settlement.

Result

The parties reached an agreement wherein the defendants admitted no wrongdoing or liability but agreed to pay $309,581 to settle class members' and PAGA claims.
