Facts

SF Tire & Service Central Inc. is a California corporation that provides automotive repair services and sells tires. Joshua Sweet is a resident of Mill Valley, and he was employed by SF Tire from 2018 until about February 2020 as a non-exempt employee who sold tires and merchandise and performed customer service in San Francisco and other Bay Area locations. Sweet filed suit against SF Tire in San Francisco Superior Court for himself and on behalf of all others similarly situated on April 22, 2020.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that the defendant failed to pay him and other class non-exempt or hourly-paid workers overtime wages; failed to provide meal periods and rest breaks; failed to pay premiums for missed or noncompliant meal and rest periods; failed to pay final wages timely; and failed to provide accurate itemized wage statements. Plaintiff also asserted claims for civil penalties for these alleged failures and for failing to provide suitable seating under the Private Attorneys General Act.

DEFENDANT'S CONTENTIONS: Defendant denied any wrongdoing or liability and all the plaintiff's material allegations. Defendant further contended that it had complied with all applicable laws.

Settlement Discussions

On July 19, 2021, the parties engaged in a mediation session with Jeffery A. Ross.

Result

The parties reached a settlement agreement wherein the defendant agreed to pay $1.475 million to settle class members' and PAGA claims.
