Matias Puglisi filed a class action and pursued a Private Attorneys General Act (PAGA) action against Storm Water Inspection & Maintenance Services, Inc. (SWIMS). The class included all of SWIMS' current and former non-exempt employees who worked for SWIMS in California during the class period.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff asserted causes of action for unpaid overtime; meal period violations and unpaid meal period premiums; rest period violations and unpaid rest period premiums; failure to pay minimum wages; failure to furnish timely and accurate wage statements; wages not paid upon termination; civil penalties under PAGA; and unfair competition.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
The parties reached an agreement wherein the defendant admitted no wrongdoing or liability but agreed to pay $500,000 to settle class members' and PAGA claims.
