Facts
On October 14, 2020, Andrei Lim, on behalf of himself and all members of the class, brought a class action against Tokyo Teriyaki Corporation dba Chowking, alleging various Labor Code violations as well as IWC Wage Order No. 5-2001. The class included all current and former non-exempt employees who worked at any time for Tokyo Teriyaki Corporation in California from October 14, 2016, to September 20, 2021. The class consisted of 1,178 members as of July 20, 2021.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: provide accurate itemized wage statements, provide compliant rest and meal breaks, and pay all wages due at termination. Further, plaintiff contended that as a result of these violations, defendant engaged in unfair business practices in violation of the California Business & Professions Code.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Tokyo Teriyaki Corporation agreed to pay $400,000 to settle all claims.
