Facts

On September 28, 2021, Jacinto Bravo, individually and on behalf of all members of the settlement class, brought a complaint against defendant employers, alleging various Labor Code violations and included a Private Attorneys General Act claim. The class included all current and former non-exempt employees of defendants in California who worked at any time from September 28, 2017, to October 10, 2022, and who did not sign a separation agreement during this time period. On August 2, 2022, the parties attended a mediation session before experienced wage and hour mediator Justice Steven M. Vartabedian (Ret.).

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay minimum wages, pay all overtime wages, provide accurate itemized wage statements, provide compliant rest and meal periods, reimburse necessary business expenses, and pay waiting time penalties for its California employees from September 28, 2017, to October 10, 2022. Further, plaintiff contended that as a result of these violations, defendants engaged in unfair business practices in violation of the California Business & Professions Code.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendants agree to pay $575,000 to settle all claims, subject to court approval.
