Facts

El Proyecto Del Barrio, Inc. operated a non-profit organization which provides healthcare and related services to underserved communities at several locations in Los Angeles County. Maria Del Socorro Jimenez, Elisa Lopez, Rose Valdez, and Osiris Gonzalez, on behalf of themselves and class members, brought a putative and representative class action against El Proyecto Del Barrio, Inc., alleging various Labor Code violations. Plaintiffs also sought recovery of civil penalties under the Private Attorneys General Act. The class included all current and former non-exempt employees employed by El Proyecto Del Barrio, Inc. in California from May 30, 2015, through April 1, 2021. On July 1, 2020, the parties attended a full-day mediation before an experienced and well-regarded mediator, Gig Kyriacou, Esq.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant failed to: provide meal and rest breaks, pay for all hours worked, pay overtime, provide accurate wage statements, and pay all wages owed at termination for its California employees during the relevant time period. Further, plaintiffs contended that as a result of these practices, defendant violated the Unfair Practices Act.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Defendant agreed pay a non-reversionary $2,150,000 payment to settle all claims.
