On June 20, 2017, Chetera Watson, on behalf or herself and all others similarly situated, brought a class action complaint against Liberty Mutual Group, Inc., alleging various Labor Code violations. The class included all non-exempt sale representatives who were employed at Liberty Mutual in California at any time from June 20, 2013, through June 2, 2021, and for at least one month during that time did not have a company-issued cell phone provided to them.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: provide reimbursements for necessary business expenses incurred in the discharge of work duties and furnish timely and accurate wage statements to its California employees during the relevant time period. Further, plaintiff alleged that defendant as a result of these actions engaged in unfair business practices in violation of California's Unfair Competition Law.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Liberty Mutual agreed to create a $157,500 fund to be divided among all persons who participated in the settlement.
