Facts
On August 26, 2020, at about 9:00 to 9:30 in the evening, John LaSalle was crossing Market Street when Frederick Gonzalez ran over his right ankle. Gonzales, a City and County of San Francisco employee, was driving a City truck at the time. LaSalle was taken to California Pacific Medical Center by ambulance and had surgery on his ankle. LaSalle filed suit against the City, County and Gonzales on January 21, 2021.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant Gonzalez was negligent in his operation of the truck owned by the City and County, which caused his injuries.
DEFENDANTS' CONTENTIONS: Defendant denied all contentions.
Settlement Discussions
On November 24, 2021, the parties participated in private mediation but were unable to reach an agreement at that time.
Injuries
Plaintiff alleged injuries to his left hand and fingers, right foot and a shattered ankle that required internal fixation surgery. On February 28, 2022, plaintiff underwent hardware removal surgery.
Result
The case settled for $489,000.
