Facts

Leovardo Navarrete worked for Dynaflex Products, a manufacturer of exhaust systems and air intake kits. On August 9, 2019, Navarrete filed a class action complaint against Dynaflex for wage and hour violations.

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant: failed to pay all minimum wages owed; failed to pay all overtime wages owed; failed to provide meal periods, or premium pay for non-compliant meal periods; failed to authorize and permit rest periods, or provide premium pay for non-compliant rest periods; failed to provide accurate, itemized wage statements; and failed to pay all wages due on termination. As a result of those violations, plaintiff further alleged that defendant was also liable for having engaged in unlawful business practices and for penalties under the Private Attorneys General Act (PAGA).

DEFENDANT'S CONTENTIONS: Defendant denied all contentions but given the uncertainty of litigation chose to settle.

Result

The parties settled for a gross settlement amount of $415,000.
