Facts

Modesto Restaurant Group is the franchisee for multiple Carl's Jr. restaurants. Leticia Rodriguez, individually and on behalf of herself and all others similarly situated, brought a class action against Modest Restaurant Group, LLC, alleging various Labor Code violations. The class included all persons who worked for Modesto Restaurant Group in California as an hourly-paid or non-exempt employee from January 21, 2017, through April 1, 2022. On November 30, 2021, the parties participated in a mediation with Kelly Knight, an experienced wage and hour class action mediator.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay all wages of any kind, including any minimum wage, overtime wages, or straight time wages; provide compliant meal breaks; authorize and permit rest periods; properly calculate any premiums owed and paid; and pay final wages or other amounts owed to its California employees during the relevant time period. Further, plaintiff contended that as a result of these violations, defendant violated the California Business & Professions Code.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Modesto Restaurant Group, LLC agreed to pay $661,431.36 to settle the action.
