Facts

Ana Maria Guerrero, an individual, on behalf of the State of California, as a private attorney general, and on behalf of all others similarly situated, brought a class action complaint against Advanced Vision Science, Inc., alleging violations of the California Labor Code, as well as a violation of the California Business & Professions Code. The class included all current and former non-exempt hourly-paid employees who are or were employed by Advanced Vision Science in California from October 30, 2014, through July 30, 2021.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay wages immediately and upon termination; provide compliant meal or rest periods; and pay overtime, minimum wages, and double time wages for its non-exempt California employees during the relevant time period. Further, plaintiff contended that as a result of these violations, defendant engaged in unfair, unlawful, or fraudulent business act in violation of the California Business & Professions Code.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Advanced Vision Science, Inc. agreed to pay $240,000 to settle the case.
