Facts

Araceli Casillas, individually and on behalf of the settlement class, brought a class action lawsuit against The Produce Exchange, Inc., alleging various Labor Code violations. The class included all exempt employees who worked for The Produce Exchange as an exempt employee in California at any time between September 20, 2015, through July 31, 2022, excluding employees who worked in the Executive, Director Jr., General Manager, IT Director, Operations Manager, and Warehouse Manager positions.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay overtime wages, provide meal and rest periods, provide accurate itemized wage statements, and pay wages due upon separation of employment for California employees during the relevant time period. Further, plaintiff contended that as a result of these violations defendant were engaged in unfair and unlawful business practices in violation of California's Unfair Competition Laws. Finally, plaintiff claimed entitlement to restitution, interest, attorneys' fees, and costs.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

The Produce Exchange agreed to pay $320,000 to settle all claims.
