Pedro Gonzalez brought a class action complaint against Arms Trans Inc., alleging various Labor Code violations. The class included all current and former drivers who worked for Arms Trans Inc. while classified as an independent contractor from October 18, 2015, through September 8, 2021. On September 24, 2020, the parties participated in an all-day mediation session with well-respected and experienced mediator, Steve Cerveris.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay all wages owed every pay period, pay minimum wages, reimburse for necessary business expenses, provide compliant meal and rest periods, properly classify, and provide accurate itemized wage statements for its California employees during the relevant time period. Further, plaintiff contended that defendant engaged in unfair competition as a result of these violations.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Arms Trans Inc. agreed to pay $270,000 to fully settle all claims.
