Facts

On October 26, 2021, Debra Ann Gonzalez, individually and on behalf of herself and all others similarly situated, brought a class action against Hayward F2, Inc., East Bay F2, Inc., Dublin F2, Inc., and Tracy F2, Inc., alleging various Labor Code violations. The class included all current and former non-exempt employees who are or were employed by defendants in California at any time from May 1, 2017, through July 8, 2022. On July 8, 2022, the parties attended a mediation session with Jill R. Sperber, Esq.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: provide compliant meal periods, authorize and permit rest breaks, provide accurate itemized wage statements, pay wages upon separation of employment, and reimburse necessary business expenses for its California employees during the relevant time period. Further, plaintiff contended that as a result of these violations, defendants engaged in unfair business practices in violation of California Business & Professions Code.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendants agreed to pay a non-reversionary $475,000,000 settlement allocated to approximately 284 class members.
