Marcos Garnica brought a class action against So Cal Retail Services, Inc., alleging various Labor Code violations. The class included all individuals who worked for So Cal Retail Services, Inc. in California as hourly non-exempt employees similarly situated to plaintiff from March 5, 2017, through March 31, 2022.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay employees all earned minimum and overtime wages, provide all legally required meal periods and rest periods or compensation in lieu thereof, provide accurate and itemized wage statements, timely pay all ages due or final wages due upon separation of employment, and reimburse for all necessary business expenses for its California employees during the relevant time period. Further, plaintiff contended that defendants engaged in unlawful business practices as a result of these violations.
DEFENDANTS' CONTENTIONS: Defendants denied all contentions.
Result
Defendants agreed to pay $250,000 to fully resolve all claims.
