On November 4, 2019, Jeffrey Almada filed a class action suit against Kriger Law Firm, A.P.C. The class members included California addressees who received a form debt collection letter from the Kriger Firm between November 4, 2018 to the following year.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant violated the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collection Practices Act in the manner by which it attempted to collect debt.
DEFENDANT'S CONTENTIONS: Defendant denied any wrongdoing and denied the claims and allegations asserted by plaintiff.
Result
Each of the 260 participating Settlement Class Members were eligible to receive a $507.11 payment, representing a pro rata portion of the $131,850.00 Common Fund, which excluded attorneys' fees and costs ($240,000) and a service award ($2,500), which were awarded separately by the court.
