Facts

On September 1, 2020, LaVeda Scott brought a class action and Labor Code Private Attorneys General Act action against HumanGood, HumanGood NorCal, HumanGood SoCal, HumanGood Fresno, and HumanGood Affordable Housing alleging various Labor Code violations. The class included all current and former non-exempt employees of defendants in California at any time from April 6, 2016, and June 2, 2022, except for Haji v. Be.Group settlement class members who did not perform work for any of the defendants after September 28, 2018. On June 2, 2022, the parties attended mediation with Michael Loeb, an experienced mediator.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: provide compliant rest periods, provide complaint meal periods, pay or timely pay earned wages, pay sick pay wages, and provide complaint wage statements for its California employees during the relevant time period. Further, plaintiff contended that defendants engaged in unfair or unlawful business practices in violation of the California Business & Professions Code.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendants agreed to pay $3,750,000 to resolve all claims.
