Facts

On August 20, 2020, Joshua Keith Seidel, individually and on behalf of all putative class members, aggrieved employees and the State of California as a Private Attorneys' General, brought a class action against AIDS Healthcare Foundation, alleging various wage and hour violations. The class included all persons employed by AIDS Healthcare Foundation in California and classified as non-exempt, hourly employees from April 24, 2018, and December 8, 2022. AIDS Healthcare Foundation estimated that there were approximately 1,049 full-time class members who worked approximately 80,000 eligible workweeks. On March 1, 2022, the parties participated in a mediation session with the Honorable Carl West and again in a second session on May 11, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay for all hours worked, including overtime hours worked; pay minimum wages owed; reimburse for required business expenses; provide required meal breaks or pay penalty wages for missed meal breaks; provide required rest breaks or pay penalty wages for missed rest breaks; timely pay all wages owed; and furnish and maintain accurate wage statements and payroll records for its California employees during the relevant time period. Further, plaintiff contended that defendant engaged in unlawful and unfair business practices as a result of these violations.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

AIDS Healthcare Foundation agreed to pay $880,000 to settle all claims.
