Facts

On November 19, 2019, Victor Lopez, on behalf of himself and all others similarly situated, brought a class action against West MB Management LLC, alleging various Labor Code violations. The class included all current and former non-exempt employees who worked for West MB Management in California at any time from November 19, 2015, through July 15, 2021. Defendant represented that there was no more than 450 class members. On January 21, 2021, the parties participated in a full day mediation session with Steve Rottman, Esquire, an experienced wage-and-hour class action mediator.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay overtime wages, pay minimum wages, pay overtime at the correct legal rate, provide compliant meal periods, provide paid compliant rest periods, provide improper wage statements, and timely pay wages to former California employees during the relevant time period. Further, plaintiff contended that defendant engaged in unfair business practices in violation of California Business and Professions Code.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

West MB Management agreed to pay $400,000 to settle all claims.
