Facts

On May 29, 2020, Janine Nelson filed a complaint against Captek Softgel International, a California corporation. Nelson filed the wage-and-hour violations complaint in Los Angeles Superior, seeking to represent current and former non-exempt employees employed by Captek Softgel from May 29, 2016 to December 31, 2021.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant violated several wage and hour laws, including: failure to pay minimum wages; failure to pay wages and overtime; meal period liability; rest period liability; failure to provide itemized statements; failure to reimburse expenses; violation of Labor Code Sections 226(a), Section 203, and Section 227.3; and violations of Private Attorneys General Act and unfair business practices statutes.

DEFENDANTS' CONTENTIONS: Defendants denied all material allegations claimed by plaintiff and further denied violating any laws.

Settlement Discussions

The parties participated in mediation with Jeffrey Ross, a wage and hour class actions mediator

Result

Defendant agreed to settle for the non-reversionary amount of $850,000.
