On March 17, 2021, Dany Stasolla, in his individual and representative capacities, brought a class action against Indo Cali Operations, alleging various Labor Code violations. The class included all delivery drivers employed by Indo Cali Operations from March 17, 2017, through April 3, 2022. On January 3, 2022, the parties participated in an all-day mediation session before experienced mediator Jeffrey Krivis that resulted in a settlement.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay wages, including minimum wages, overtime, and double time wages; provide compliant meal periods and associated premium pay; provide compliant rest periods and associated premium pay; provide compliant wage statements; reimburse necessary work-related expenses; timely pay wages upon termination of employment; timely pay wages during employment; and maintain requisite payroll records for its non-exempt California employees during the relevant time period.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Indo Cali Operations agreed to pay $150,000 to resolve all claims.
