Gary Gonzalez was employed by Star Waggons, Inc., as a non-exempt employee. On October 22, 2020, Gonzalez filed suit on behalf of himself and all others similarly situated against Star Waggons.
Contentions
PLAINTIFF'S CONTENTIONS: The plaintiff contended that the defendant had failed to pay minimum wage; to provide overtime wages; to timely pay wages; to provide meal periods and rest breaks; to provide accurate itemized wage statements; to pay timely wages upon separation of employment; and engaged in unlawful business practices. The plaintiff also contended that the defendant was liable for civil penalties under the Private Attorneys General Act for the alleged violations of the Labor Code.
DEFENDANT'S CONTENTIONS: The defendant denied any wrongdoing or liability and all the plaintiff's material allegations.
Result
The parties reached an agreement wherein the defendant admitted no wrongdoing or liability but agreed to pay $167,500 to settle class members' and PAGA claims.
