Facts

Jose Alfonso Macedo was a former employee of Claud Townsley, Inc. On January 25, 2021, Macedo, on behalf of himself and others similarly situated, brought a class action against Claud Townsley, Inc., alleging various Labor Code violations. The class included all persons currently or formerly employed by Claud Townsley, Inc. in California and classified as non-exempt, non-supervisory roofers from January 25, 2017, through December 28, 2022. On August 11, 2021, the parties participated in an all-day mediation presided over by professional neutral, Honorable Thierry Patrick Colaw (Retired). Claud Townsley, Inc. estimated that there were 32 class members and 6,525 total workweeks during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that the defendant failed to: pay all wages, including minimum wages, straight-time compensation, overtime compensation, double-time compensation, and interest; provide compliant meal periods and rest breaks or premium compensation in lieu thereof; provide accurate itemized wage statements; and pay wages due upon separation of employment for its California employees during the relevant time period. Further, plaintiff contended that defendant engaged in unfair business practices in violation of the California Business & Professions Code.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Claud Townsley, Inc. agreed to pay $275,000 to settle all claims.
