Facts

Simon Dethrasavong, on behalf of himself and all others similarly situated or aggrieved, brought a class action against ASI Computer Technologies, Inc., alleging various Labor Code violations. The class included all current and former non-exempt, hourly-paid employees who worked at any time for ASI Computer Technologies, Inc. from August 21, 2016, through January 1, 2022, including thirty-two employees who were allegedly misclassified by ASI as "exempt" employees. ASI Computer Technologies represented that there were 20,739 workweeks worked by the class members during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay overtime wages, pay minimum wages, provide compliant meal and rest periods and associated premium pay, timely pay all wages due upon termination or resignation, provide compliant accurate wage statements, timely pay wages during employment, and reimburse for necessary business expenses for its California employees during the relevant time period. Further, plaintiff contended that defendant violated the California Business & Professions Code as a result of these labor violations.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

ASI Computer Technologies, Inc. agreed to pay $1,036,950 to settle all claims.
