Facts

Robert Gonzalez, Victor Penate, Blake Bixel, and Mikail Odubona filed suit against Speedy Weedy La Mesa, Speedy Weedy Santa Ana, Speedy Weedy Vista, and Welcome Healing Touch in San Diego Superior seeking to represent non-exempt or independent contractor employees who worked at some point between September 4, 2016 through June 1, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs contended that defendants failed to pay all minimum wages; failed to pay overtime wages; failed to provide meal periods; failed to permit rest breaks; failed to pay all wages due upon separation of employment and within the required time; failed to provide accurate itemized wage statements; failed to reimburse necessary business expenses; and that those violations were unfair and unlawful business practices under Unfair Competition Laws, entitling them to recover civil penalties under the Private Attorneys General Act.

DEFENDANTS' CONTENTIONS: Defendants made no admissions as to the allegations and disputed all liability.

Settlement Discussions

On April 28, 2022, the parties participated in a full-day mediation with Gig Kyriacou, and reached a settlement agreement.

Result

Defendants have agreed to pay $777,645 to settle all claims.
