Facts

Shawn Lee and Hector Ramirez filed suit in San Bernardino County Superior against their former employer, ComAv Technical Services, alleging wage-and-hour violations. They sought to represent hourly employees who worked during the period of October 6, 2016 through December 31, 2021. They also sought penalties under the Private Attorneys General Act for employees working during that same period.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants violated labor laws by failing to pay overtime wages, minimum and straight time wages, wages due on termination and reimbursable expenses and failing to provide meal periods, rest breaks and accurate itemized wage statements, along with PAGA claims.

DEFENDANT'S CONTENTIONS: Defendant strongly denied violating any laws or failing to pay any wages, contending it complied with all applicable laws.

Result

The case settled with defendant agreeing to pay the gross settlement amount of $525,000.

Other Information

The final approval hearing will be held on June 20, 2023.
