Facts

Cristina Jaochico began working for Caritas Management Corp. as a non-exempt hourly on-call hotel desk clerk from May 7, 2018, until he was promoted to full-time desk clerk on July 10, 2018. She was terminated from her employment on January 24, 2019. On April 12, 2019, Jaochico, on behalf of herself and all others similarly situated and as an aggrieved employee on behalf of other aggrieved employees, brought a class action against Caritas Management Corp., alleging various Labor Code violations. The class included all persons employed in the position of hourly, non-exempt desk clerk in California from April 12, 2015, through October 14, 2021. Defendant estimated there were approximately 155 members in the settlement class.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: provide compliant meal and rest periods; provide accurate written wage statements; pay wages for all hours worked; and timely pay wages upon termination of employment for its California employees during the relevant time period. Further, plaintiff contended that as a result of these violations, defendant engaged in unfair competition in violation of the California Business & Professions Code.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Caritas Management Corp. agreed to pay $350,000 to settle all claims.
