Facts

Plaintiff Lizette Robinson, a 57-year-old former Assistant Branch Manager with Savings Bank of Mendocino County was terminated a week after submitting a written document objecting that SBMC's policies were being applied inconsistently to employees. Robinson did not violate any specific SBMC policy. SBMC instead claims she did not engage in protected activity, that she said the Bank was applying its policies in a way that was "unfair" as opposed to "discriminatory," and that SBMC "lost confidence" in her ability to effectively manage employees after reading the concerns she made about her working conditions."

Result

The court found that plaintiff neither engaged in protected activity nor was retaliated against for having done so, and granted defendant's motion for directed judgment following a 4-day bench trial.
