On June 11, 2021, Destinee Hart, individually and on behalf of the class, brought a class action against ALIKA LLC dba Carlton Oaks Golf Club, alleging various Labor Code violations. The class included all current and former non-exempt hourly employees working for ALIKA LLC in California at any time from June 11, 2017, through August 31, 2022. On August 30, 2022, the parties participated in a mediation session before the well-respected and experienced wage and hour class action mediator Barry M. Winograd, Esquire.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay all straight-time and overtime wages for all work performed, provide compliant duty-free meal breaks or pay premiums at the regular rate of compensation, provide compliant duty-free rest periods or pay premiums at the regular rate of compensation, reimburse all incurred business expenses, provide accurate itemized wage statements, and pay all wages upon separation of employment for its California employees during the relevant time period. Moreover, plaintiff contended that defendants violated the Business and Professions Code based on the aforementioned violations.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Defendant agreed to pay $310,106 to settle all claims.
