Facts

On April 22, 2021, Thomas Pena, Eric Ulbrich, and Mark Ramsey brought a class action against their former employers, Ayzenberg Group, Inc., Eric Ayyzenberg, Adriane Zaudke, and Kristen Vaik Vazquez, alleging various wage and hour violations. The class included all persons paid compensation (directly or through a loan-out entity) on account of services provided for Defendant in the production of Motion Pictures from October 24, 2016, through February 8, 2023. Defendants estimated there were approximately 740 class members. On November 17, 2021, Pena and Ayzenberg participated in an all-day mediation presided over by Joel Grossman of JAMS that resulted in settlement.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants failed to: provide complaint pay stubs, pay overtime wages, pay minimum wages, pay wages due upon termination, provide compliant meal breaks, provide compliant rest breaks, reimburse for necessary business expenses, and provide employment records for its California employees during the relevant time period. Further, plaintiffs alleged that defendants engaged in unfair competition in violation of the California Business & Professions Code as a result of the aforementioned violations.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendants agreed to pay $600,000 to settle the case.
