Facts

Steven DelCorso and others brought a class action and pursued a representative Private Attorneys General Act (PAGA) action against ITS Technologies & Logistics, LLC, a leading provider of rail intermodal terminal services; Conglobal Industries, LLC; and Conglobal Transport, LLC.

The class included all individuals employed by ITS; Conglobal Industries; and/or Conglobal Transport as an hourly paid and/or non-exempt employee within the State of California at any time during the class period.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs asserted claims for violation of the California Labor Code, including claims for unpaid overtime; unpaid rest period premiums; unpaid minimum wages; final wages not timely paid; noncompliant wage statements; unreimbursed business expenses; and violation of the Business & Professions Code. Plaintiffs also asserted claims for PAGA penalties.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

The parties attended mediation with mediator David Phillips, Esq., and were ultimately able to reach a settlement of the plaintiffs' claims.

Result

The case settled for $1.5 million.
