Facts

Jose Rodriguez, Jose Vega Villalobos, and Ahmed Albeoul, individually and on behalf of themselves, brought a class action against Synergy Enterprises, Inc., Eagle Systems International, Inc., dba Synergy Companies, Steven R. Shallenberger, and David Clark, alleging various Labor Code and Healthy Workplace Healthy Family Act violations. The class included all individuals who were employed by any of the defendants in California during the period of March 5, 2016, through December 31, 2020, and during which period worked at least one qualifying workweek under a performance bonus compensation plan, by which a bonus was paid based on itemized measures performed net of hourly compensation paid during the pay period. The parties also participated in two days of mediation on November 13, 2020, and December 8, 2020, with a neutral third party.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants failed to: pay overtime wages, pay minimum wages, provide accurate wage statements, timely pay final wages, provide meal and rest periods or pay premiums in lieu thereof, pay sick leave, reimburse expenses, pay contract wages, timely pay wages, and maintain accurate records for its California employees. Further, plaintiffs alleged that defendants engaged in unfair competition as a result of the aforementioned violations.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendants agreed to pay $900,000 to settle the case.
