Facts

Angel Medina, individually and on behalf of all others similarly situated, brought a class action against National Paving Company, Inc., alleging various Labor Code violations. The class included all current and former non-exempt, hourly employees who worked for National Paving Company, Inc. in California at any time between March 19, 2017, through December 8, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant failed to: reimburse business expenses, provide accurate itemized wage statements, provide all required meal and rest periods or pay premium pays for non-compliant rest and meal periods, pay all minimum and overtime wages, and pay all wages due upon termination for its California employees during the relevant time period. Further, plaintiff alleged that defendant engaged in unfair business practices and was liable for civil penalties as a result of the foregoing alleged violations.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

National Paving Company Inc. agreed to pay $150,000 to settle the case.
