On June 8, 2020, Oscar Lopez Villareal filed suit on behalf of himself and on behalf of those similarly situated against Deco Logistics, Inc. dba Container Connection.
Contentions
PLAINTIFF'S CONTENTIONS: The plaintiff contended that the defendant failed to pay minimum wages; failed to pay overtime wages; failed to timely pay wages upon separation from employment; failed to provide meal or rest breaks; failed to pay premiums in lieu of meal or rest periods; failed to provide accurate itemized wage statements; failed to reimburse necessary business expenses; and engaged in unfair business practices. Moreover, the plaintiff contended that the defendant was liable for civil penalties under the Private Attorneys General Act.
DEFENDANT'S CONTENTIONS: The defendant denied any wrongdoing or liability and all the plaintiff's material allegations.
Settlement Discussions
On October 11, 2021, the parties participated in a mediation session with the retired Honorable Carl West.
Result
The parties reached an agreement wherein the defendant admitted no wrongdoing or liability but agreed to pay $6.2 million to settle class and PAGA claims.
