Facts

Plaintiff Jose Chavarria sued the City and County of San Francisco for negligence after an SFPD vehicle rolled into him and another police officer while he was being detained at a bus stop. Chavarria claimed injuries, disability, and damages.

Contentions

PLAINTIFF'S CONTENTIONS: Chavarria contended that the City negligently owned, operated, and maintained the vehicle that struck him while he was being detained as a pedestrian at a bus stop. He alleged that he incurred significant medical expenses, as well as lost wages and future earning capacity as a result of his injuries.

DEFENDANT'S CONTENTIONS: The City denied Chavarria's contentions and moved to compel Plaintiff to authorize the release of his mental health records, which the court denied.

On January 24, 2023, the parties filed a notice of settlement. Under the settlement, the City authorized payment to plaintiff of $3,000,000 as well as a waiver of $33,607.51 offset for unpaid Zuckerberg San Francisco General Hospital bills.

The case settled for a payment of $3 million and the City to waive $33,608 offset for unpaid Zuckerberg San Francisco General Hospital bills.
