Facts

In August 2017, Bill Bailey, a Marin County resident, applied for a deputy sheriff position with the San Francisco Sheriff's Department. Sometime around April 4, 2018, Bailey alleged that he received a "Conditional Offer of Employment" from the Department that was contingent on completion of a medical exam and background investigation. Bailey signed the offer and sent it back to the Department. A month thereafter, Bailey went in for the psychological interview and later the medical exam, both being administered through the Department. In June 2018, Bailey was informed of potential medical issues raised by the doctor. Though Bailey subsequently informed the Department that he would like to continue with the hiring process and do what he could to address any potentially disqualifying medical issues, he received a letter in July that he had not been selected. Bailey then learned he was disqualified as a candidate based on a review of his background and he thereupon filed a complaint with the Department of Fair Employment and Housing who issued him a right to sue letter. On October 27, 2020, Bailey, proceeding pro se, filed suit against the Department for employment discrimination, and discriminatory hiring practices.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant discriminated against him, that the conditional employment offer was fake, leading to plaintiff submitting to stressful and time-consuming medical examinations for no reason.

DEFENDANTS' CONTENTIONS: Defendants denied all material contentions.

Result

The case settled for $52,500.
