Facts

Brenda's LLC dba Brenda's French Soul Food is a California limited liability company located at 652 Polk St., San Francisco, California that employed Joshua Park as an hourly-paid, non-exempt server until July 2018 in California. On April 26, 2022, Park, individually, and on behalf of other members of the general public similarly situated, brought a class action against Brenda's LLC dba Brenda's French Soul Food, alleging various Labor Code violations. The class included all current and former hourly-paid or non-exempt of Brenda's French Soul Food within California at any time from October 29, 2017, through March 27, 2023.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay minimum wages and overtime wages, provide meal periods and rest breaks, provide legally required overtime compensation, properly calculate the regular rate of pay, provide complete and accurate itemized wage statements, provide sick days, timely pay final wages during employment and upon termination, and reimburse business expenses for its California employees during the relevant time period. Further, plaintiff alleged that defendant engaged in unlawful business acts and practices in violation of the California Business & Professions Code as a result of these aforementioned violations.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Brenda's LLC agreed to pay $450,000 to settle all claims.
