Facts
Both Camille Bourque and Peter Morejon work for the City of Los Angeles. On May 12, 2021, Bourque and Morejon filed suit in USDC Central against the City, the Engineers and Architects Association (EAA) and Attorney General Rob Bonta in regards to EAA fees deducted from their paychecks.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs asserted that because the deducted amounts became part of funds used to make political statements they disagreed with, the deductions violated their First Amendment and Due Process rights.
DEFENDANTS' CONTENTIONS: Defendants denied all material contentions. Moreover, they contended, among others, that plaintiffs' allegations were moot given that the deductions were no longer being made from their paychecks and refunded with interest. Finally, plaintiff failed to show a likelihood of reinjury.
Result
The court granted summary judgment dismissing plaintiffs' complaint with prejudice.
