Facts

Shannon Williams and Johnathan Tumblin worked for lab-testing service companies, Labcorp Employer Services, Labcorp Staffing Solutions, and Wellness Corporate Solutions, providers of mobile health services. On September 2, 2020, Williams and Tumblin filed suit in Los Angeles Superior against those entities seeking to represent those who worked for them from February 5, 2019 to April 18, 2023.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants violated California labor laws by requiring them to perform off-the-clock work. They also failed to: pay proper overtime; reimburse necessary business expenses; provide meal and rest breaks, accurate pay stubs, or timely pay wages on separation from employment. Based on these claims, plaintiffs further asserted claims for Private Attorneys General Act penalties.

DEFENDANTS' CONTENTIONS: Defendants strongly denied violating any laws or that they failed to pay wages, contending that they complied with all applicable laws.

Settlement Discussions

On February 18, 2022, the parties engaged in a full-day mediation with Todd Smith, Esq. which resulted in the agreed settlement.

Result

The case settled for $2.7 million.
