Facts
Alberto Roman and Peter Alvarado worked, as non-exempt employees, for TRM Manufacturing, manufacturers of plastic film, sheeting, bags, plus shrink and mulch films. They filed suit in Riverside Superior seeking to represent those who worked for TRM from April 13, 2013 through November 14, 2021.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant violated certain wage-and-hour laws by failing to: pay wages; provide meal periods; permit rest breaks; provide accurate, itemized wage statements; and pay all wages due on separation and within the required timeframe. As these actions also violated provisions of the unfair business practices and Private Attorneys General Act laws, plaintiff asserted that they were also entitled to civil penalties.
DEFENDANT'S CONTENTIONS: Defendant denied all factual and legal allegations in the lawsuit, asserting that it complied with the law at all times.
Result
Defendant agreed to pay up to $4,020,069.33 to settle the claims.
