On January 8, 2020 Lance Linden, as an individual and on behalf of all similarly situated employees, brought a class action against Marugame Udon USA, LLC, alleging various Labor Code violations. The class included all current and former non-exempt employees of Marugame Udon USA, LLC within California at any time from January 8, 2016, through July 31, 2022. On January 30, 2020, Nereyda Rodriguez filed a class action complaint alleging similar violations. On July 14, 2020, Alice Turner filed a factually similar complaint under the Private Attorneys General Act. On September 10, 2021, plaintiffs filed a second amended consolidated complaint. On April 28, 2022, the parties mediated before Steven Rottman, Esquire, before agreeing to a settlement agreement.

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant failed to: provide complaint meal and rest periods, pay overtime and minimum wages, properly calculate rest and meal period premiums, provide accurate itemized wage statements, timely pay final wages, and reimburse business expenses for its California non-exempt employees during the relevant time period.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Marugame Udon USA, LLC agreed to pay $700,000 to settle the case.
