The City of Manhattan Beach provides certain services for its residents including a Dial-a-Ride bus service for its elderly and/or disabled residents. In October 2021, Ulysses Rivas, who worked as a commercial bus driver for the City, filed a wage-and-hour lawsuit against the City seeking to represent employees who worked as bus drivers from October 20, 2018 to March 10, 2023. Rivas later sought penalties under the Private Attorneys General Act.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant systemically violated wage-and-hour laws by enforcing policies and procedures that deprived its employees of meal and rest breaks. Moreover, plaintiffs asserted that defendant failed to timely pay all wages when it was due.
DEFENDANT'S CONTENTIONS: Defendants vigorously denied all material contentions.
Settlement Discussions
The parties engaged in mediation with Steve Pearl on December 13, 2022, which resulted in a settlement.
Result
The case settled for $105,000.
