On February 13, 2021, Jon Theadore, individually and on behalf of all others similarly situated, brought a class action against Blommer Chocolate Company, alleging various Labor Code and Business & Profession Code violations. The class included all hourly, non-exempt individuals who are or previously were employed by Blommer Chocolate Company in California from August 18, 2016, through June 30, 2022. Blommer Chocolate Company estimated there were approximately 348 individuals. On June 16, 2021, Theadore filed a Private Attorneys General Act complaint against Blommer Chocolate Company that was consolidated into the earlier case.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant through its practices or policies violated the California Labor Code. Further, plaintiff contended that defendant engaged in unlawful, unfair, or fraudulent business acts or practices in violation of the California Business & Professions Code.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Settlement Discussions
On March 7, 2022, the parties attended a mediation session with Jeffrey Ross and agreed to the mediator's proposal.
Result
Blommer Chocolate Company agreed to settle all claims for $1.4 million.
