Facts

On December 2, 2021, Mathew Lantz, individually and on behalf of other members of the general public similarly situated, brought a wage-and-hour class action against Trio Manufacturing Inc., alleging various Labor Code violations. The class included all current and former non-exempt hourly employees who are or were employed by Trio Manufacturing Inc. in California at any time from December 2, 2017, through February 28, 2023. Trio Manufacturing Inc. estimated there were 235 class members who collectively worked a total 21,116 workweeks. On November 30, 2022, the parties participated in an all-day mediation presided over by Mark S. Rudy, which led to a settlement agreement.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant failed to: pay overtime, pay meal period premiums, pay rest period premiums, pay minimum wages, pay final wages not timely paid, provide non-compliant wage statements, and reimburse for necessary business expenses for its California employees during the relevant time periods. Plaintiffs contended that defendant was liable for Private Attorneys General Act penalties.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Trio Manufacturing Inc. agreed to pay $633,000 to settle all claims.
