On July 14, 2020, Juan Siempre Javier filed a lawsuit against Webster Bros. Concrete Construction and others, seeking to represent all non-exempt employees who were employed by Webster between July 2016 to June 2022.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff generally contended that defendants violated state wage-and-hour laws and accordingly, is liable for, among other things, unpaid wages, reimbursable business expenses, penalties, etc. Plaintiff also sought penalties pursuant to the Private General Attorneys Act.
DEFENDANTS' CONTENTIONS: Defendants denied all material contentions. Specifically, Defendants denied violating any laws or failing to pay any wages and contended that they complied with all applicable laws.
Result
The case settled for $325,000.
