Facts

On January 31, 2019, Hector Quiroz filed a wage-and-hour lawsuit against his former employer, International Aerospace, Coatings, Inc. in San Bernardino Superior. A year later, on December 8, 2020, Francisco Aguila also filed a complaint against International Aerospace making similar allegations in the same court.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant failed to: pay wages; provide meal and/or rest periods; pay wages due on separation; provide accurate, itemized wage statements. They also included a cause of action for penalties under the Private Attorneys General Act (PAGA).

DEFENDANT'S CONTENTIONS: Defendants denied plaintiff's contentions, asserting, among others, that class members were: proper and timely paid wages; properly reimbursed; provided meal and rest periods.

Settlement Discussions

On July 21, 2021, the parties participated in a private mediation session with retired judge, Hon. Carl West. Though unable to resolve the matter that day, a second mediation session with mediator Mark LeHocky on April 4, 2022, resulted in a settlement agreement two days later.

Result

The case settled for $725,000, with the employer taxes paid separately by International Aerospace and not paid out of the gross settlement amount.
