Facts

On October 9, 2021, Bi Jun Zhang was riding her electric scooter eastbound on Mission Street in San Francisco. Somewhere between 8th and 9th Street, there were cracks and holes in the street, which led to her being thrown off her scooter. She then filed suit against the City and County of San Francisco on May 17, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that the uneven street pavement caused her scooter to veer and twist, causing her to be thrown off. The dangerous condition should have been known to defendants especially given that the area is frequently transited.

DEFENDANTS' CONTENTIONS: Defendants denied all material contentions. Specifically, defendants contended, among others, that certain provisions of California's Transportation and Vehicle Codes barred plaintiff's lawsuit.

Result

The City and County of San Francisco's Board of Supervisors approved a $35,000 settlement.
