Facts
On February 6, 2019, Tony McCoy filed a wage-and-hour complaint against his former employer, Road Runner Sports Inc., with the American Arbitration Association. Another employee, Mariana Ramirez, later brought additional claims. The action was also brought to Los Angeles Superior.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant failed to provide compliant meal and rest periods along with associated premium pay; did not properly pay employees all wages owed for time worked; did not provide accurate wage statements; did not timely pay all wages owed at termination; failed to reimburse for necessary business expenses; and maintained unfair business practices. Consequently, plaintiffs also sought Private Attorneys General Act (PAGA) penalties.
DEFENDANT'S CONTENTIONS: Defendant denied not only all alleged violations but also that it owed any remedies.
Result
The parties settled for a maximum of $3.5 million.
