Facts

This case concerns a city construction contract dispute between CPM Environmental Inc., Build Group, Inc., and San Francisco. Build agreed to supply labor and materials necessary to construct improvements for San Francisco's Maxine Hall Health Center. It alleged that San Francisco breached the terms of the parties' contract by failing to provide Build with complete and accurate construction documents; failing to promptly resolve conflicts and ambiguities in the plans and specifications; deliberately refusing to make all payments due; and refusing to acknowledge and approve requests for change orders. Build also alleged claims for breach of implied warranty and implied contractual indemnity.
