Maria Hernandez filed suit against RMP Safety Service, Inc. and Inspire Diagnostics, LLC on behalf of herself and on behalf of all others similarly situated in Los Angeles County Superior Court.
Contentions
PLAINTIFF'S CONTENTIONS: The plaintiff contended that the defendants failed to pay all wages due upon separation from employment; failed to provide accurate itemized wage statements; failed to pay minimum wages as required by law; failed to pay overtime wages as required by law; and failed to provide meal and rest breaks. As a result of these failures, the plaintiff contended the defendants were liable for damages, as well as civil penalties under the Private Attorneys General Act.
DEFENDANTS' CONTENTIONS: The defendants denied any wrongdoing or liability and all the plaintiff's material allegations.
Result
The parties reached a settlement agreement wherein the defendant agreed to pay $745,000 to settle class and PAGA claims.
